These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Malay Pandit ("we," "us," "our," or "Service Provider") regarding your use of the Pause Care mobile application ("App," "Application," or "Service").

By downloading, installing, accessing, or using Pause Care, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

Pause Care is a mobile wellness application designed to help users manage anxiety, panic attacks, and stress through guided breathing exercises and mood tracking features. The App provides:

Monthly and Yearly subscriptions automatically renew unless you cancel before the renewal date. You will be charged through your Apple ID or Google Play account at confirmation of purchase and at each renewal period.

Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition, anxiety disorder, or mental health concern. Never disregard professional medical advice or delay seeking it because of something you have used or read in the App.

If you are experiencing a medical emergency, severe panic attack, suicidal thoughts, or are in crisis, immediately call emergency services (911 in the US), go to the nearest emergency room, or contact:

Certain breathing exercises may not be appropriate for individuals with specific medical conditions (e.g., respiratory disorders, heart conditions, pregnancy). Consult your doctor before starting any new breathing practice.

MAXIMUM LIABILITY: In no event shall our total aggregate liability to you for all claims arising out of or related to the App exceed the greater of: (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) $100 USD.

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in the State of West Bengal, without regard to its conflict of law provisions.

For users outside of India, any disputes that cannot be resolved informally may be subject to binding arbitration in accordance with the rules of the International Chamber of Commerce (ICC), with arbitration to be conducted in English.

16.5 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements, understandings, and communications.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, internet failures, or telecommunications infrastructure failures.

By using the App, you consent to receive electronic communications from us, including emails, push notifications, and in-app messages. You agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing.

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any government list of prohibited or restricted parties.
